Mr. Grobstein’s Yellow Laminated Spanish Instructions

The other day on Mr. Grobstein’s calendar he had  case in which the debtors had to have a spanish translator. As we have mentioned in this blog before, the translator is provided free of charge by the United States Trustee. If you client needs a translator, just ask the trustee before your client’s hearing starts and he or she will call a translator for the your client. This service is provided by all the bankruptcy trustees in our Division.

Bankruptcy Trustees and Internet Searches

The other day on the Chapter 7 Trustee Howard Grobstein, the United States Trustee’s representative asked a debtor about a house that he may have owned.

Debtor said that he used to own the property but he transferred it. The UST rep. said she searched on the public data bases and that he was still the owner. This house was not listed in the petition. Trustee Grobstein then asked for more information on this transfer.

In previous posts we talked about how Riverside Chapter 7 Bankruptcy Trustees schedule their continued cases. As the filings have gone down, the bankruptcy trustees are handling the downturn in different ways. The US Trustee has scheduled our chapter 7 trustees fewer times per month and there are no new cases scheduled for Fridays in Riverside.

CCP 704 and Tax Refunds

The other day on Riverside Bankruptcy Trustee Howard Grobstein’s calendar there was a debtor that had a house that had some much equity that the debtor’s attorney had to use CCP704 to exempt the equity. The exemption covered the house, so the house was protected. The problem though was that the Debtor also had a 2014 tax refund that he is due.

The Debtor’s attorney tried to exempt the potential tax refund under CCP704.070.

US Trustee Questions for 707(b)

Riverside Trustee Howard Grobstein’s job is to make sure the chapter 7 debtors qualify for chapter 7 and not a chapter 13. If Mr. Grobstein and his staff feel the debtor does not qualify, they refer the matter to the US Trustee.

Address of Employer

 Riverside, California Chapter 7 Trustee Howard Grobstein will ask every debtor that sits in front of him if the name and address of their employer is listed in the petition and it is true and correct. The Chapter 7 Trustee is tasked by the US Trustee to make sure the name and address of the debtor’s employers is listed on Schedule “I” of the petition.

 Chapter 7 Trustee Howard Grobstein starts each of his calendars with the same announcement that the Unites States Government provides free of charge a translator for those you do not understand english. All the debtor has to do is ask the trustee when he comes up for his examination at the meeting of creditors.

False Social Security Card

Chapter 7 Bankruptcy Trustee Howard Grobstein asked a debtor today if her Social Security card was valid. He said that the paper printed and the type style was different than the regular Social Security cards given by the Social Security Administration. The debtor said that she lost her original and that this was a replacement card. The Trustee took a copy of the presented card. Then he continued the case for other reasons. Aggressive Investors in Bankruptcy Cases

House Prices are Increasing

I spoke to Chapter 7 Riverside Trustee Howard Grobstein and asked him what are the issues that he is seeing as a trustee these days. Mr. Grobstein said that since house prices are increasing, attorneys are not keeping up with the changes. He routinely sees lawyers listing real property values at significantly less than what the market will allow.
