Furniture In Bankruptcy

Last week on Mr. Whitmore’s calendar a creditor appeared to ask a debtor questions. Mr. Whitmore conducted the hearing and asked the basic questions at the meeting of creditors. The debtor answered the questioned satisfactorily, then Trustee Whitmore asked if there were any creditors.

The creditor’s representative appeared and stated he was from a furniture company. He asked if the debtor had purchased certain items in 2014? The debtor said “yes”. The creditor then asked if he still had those items. ...

Bankruptcy Interior Inspection of Property

Today in Riverside Bankruptcy Trustee Todd Frealy’s hearing calendar there was a debtor who had a house. The house was valued in his petition for a certain amount. When Trustee Frealy reviewed the petition he ran a “zillow.com” appraisal on the property. The value on the zillow.com was higher than was listed in the petition. This is a common occurrence as the web based valuation service are estimates. The web sites are rough guesses on what the property ...

Riverside Chapter 7 Trustee Steve Speier’s meeting of creditors last week had several cases that were converted from chapter 13 to chapter 7. This cases are interesting because they were confirmed with the clients having the ability to make payments to the chapter 13 trustee and now the clients cannot make the payments.

From a chapter 7 trustee’s perspective, the chapter 7 trustee would want to know why the case was converted? Last week, one couple said that they converted because ...

Over Bidders at Bankruptcy Auctions

Posted by:

The other day I was speaking with Riverside Chapter 7 Trustee Todd Frealy. He said that he has been involved in several auctions for chapter 7 trustees where there have been “over-bidders” on the property. This means that the property the trustee collects that is not-exempt is then sold to bidders at an auction at a price that is more than expected. The Trustee will usually make a deal with the debtor to have the debtor “buy back” ...
